With extensive experience in Guardianship matters, including acting as a guardian for hundreds of clients throughout Southern New England, our firm is uniquely positioned to guide you through every legal process involved. If a resident or patient at your facility becomes incapacitated and does not have a healthcare proxy, it is crucial to petition the court for the appointment of a Guardian. The appointed Guardian is entrusted with the vital responsibility of providing consent for the individual's treatment and medical care. In certain circumstances, the court may grant the Guardian specific authority to admit the resident to a facility. Whether a guardian is appointed or Connelly Law serves as the guardian for the patient, resident, or client, we are prepared to assist you at every step.

It is important to recognize that guardianships may require special authority, which must be explicitly requested from the court. Such extraordinary powers can include:

  • Authorization for treatment with antipsychotic medications

  • Consent for surgical interventions

  • Authority to refuse medical care and procedures

  • Issuance of Do Not Resuscitate (DNR) orders

  • Do Not Intubate (DNI) directives

  • Do Not Hospitalize (DNH) requests

  • Establishing Comfort Measure Only (CMO) medical orders

 

Should a resident regain the capacity to make their own medical decisions, Connelly Law is ready to represent you in terminating the guardianship, ensuring the restoration and respect of the individual's autonomy. Conservatorships: A conservator serves as a crucial protector of the financial well-being and best interests of individuals who, due to incapacity, disability, or other challenges, are unable to manage their financial affairs independently. When a conservator is appointed, it provides assurance that the resident’s assets—such as bank accounts, real estate, and personal property—are carefully safeguarded and managed in accordance with established legal and ethical standards. The conservator is responsible for ensuring that all financial obligations are met, including paying bills, budgeting for ongoing needs, and preserving assets for future use. This role provides peace of mind not only to the resident but also to their loved ones, knowing that all monetary matters are handled with diligence and integrity.

 

Connelly Law can support the conservator already named by the court or, if appropriate, act as the conservator for your patient/resident/client, providing flexible solutions tailored to your unique circumstances. Should the individual's condition improve and they regain the capacity to make informed decisions, our team is prepared to assist with the legal process to terminate the conservatorship, ensuring a smooth, well-documented transition.
